Terms of Service

These Terms of Service («Terms») govern your access to and use of https://air-obd.com (the «Site»), our web dashboard at airobd.eu.biz.ua, and the AIR OBD physical devices (the «Products»), all operated by UAB EUSPRO, registered in Lithuania («we», «us», «EUSPRO»).

By using the Site or buying a Product, you accept these Terms. If you do not accept them, please do not use the Site or buy our Products.

1. The company

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or place an order. By placing an order you confirm that you have the legal capacity to enter into a binding contract.

3. Acceptable use

You may use the Site and Products only for lawful purposes. You agree not to:

• Violate any applicable law or regulation, including automotive emissions, road-safety, and type-approval standards;
• Use the Products on a vehicle you do not own or are not explicitly authorised by its owner to work on;
• Alter, roll back, or falsify odometer readings or service records;
• Bypass, clone, or disable immobiliser, anti-theft, or key-security systems, except with the vehicle owner’s authorisation and in compliance with local law;
• Defeat, remove, or disable emissions-control systems (DPF, EGR, SCR/AdBlue, catalytic converter, OBD monitors) where prohibited;
• Clone, alter, or falsify vehicle identification data (VIN, ECU serial numbers, component IDs);
• Circumvent manufacturer security, licensing, or anti-tamper measures in violation of law;
• Use the Products in connection with stolen vehicles, insurance fraud, or any other criminal activity;
• Attempt unauthorised access to the Site, the dashboard, or the bridge protocol;
• Reverse-engineer, copy, or redistribute our software, firmware, or content without written permission;
• Resell the Products as your own brand (white-labelling is not offered).

Use of the Products in breach of this Section voids the warranty (Section 7) and may result in refusal of support, without prejudice to our other remedies.

4. Orders, prices, and payments

• All prices are listed in EUR and may change without prior notice. The price at the moment of checkout applies to your order.
• Payment is due at the time of order and is processed by Stripe. We do not store your card details.
• VAT is calculated automatically by Stripe based on your country. EU companies may enter a valid VAT ID at checkout to remove VAT (reverse charge).
• Worldwide shipping is €20, added at checkout. We use the fastest postal carrier available to your country.
• Estimated delivery: 5–10 business days after dispatch. Customs duties (for non-EU destinations) are payable by the buyer.
• We may cancel or refuse any order at our sole discretion (e.g. suspected fraud, unavailable stock, sanctioned jurisdiction). If we do, we refund the full amount.

5. Product description and licensing

The Product consists of two role-fixed devices (Master and Slave) that establish a peer-to-peer link between any vehicle’s OBD2 port and any compatible diagnostic tool, over the public internet.

• Devices ship fully activated and tested.
• A 1 year license for software updates and technical support is included from the factory. After 12 months the device continues to function; updates and support require a renewal (offered separately and never as a subscription).
• We strive to keep product descriptions and images accurate, but do not warrant they are entirely error-free. If a Product you receive is materially different from its description, contact us within 14 days.

6. Right of withdrawal (EU consumers)

If you are an EU consumer (purchasing for purposes outside your trade or profession), you have the right to withdraw from the contract within 14 days of receiving the Product, without giving any reason.

• To withdraw, email info@air-obd.com with your order number and a clear statement of withdrawal.
• Return the Product to our address in the same condition you received it. Return shipping is at your expense.
• We refund the full purchase price (excluding original shipping) within 14 days of receiving the returned Product.
• Withdrawal is not available if the Product’s seal is broken in a way that makes it non-resellable, or if the Product has been used in a way that significantly reduces its value.

7. Warranty

All AIR OBD devices come with a 2 year manufacturer warranty from the date of delivery, in addition to the legal conformity warranty under EU Directive 2019/771.

• The warranty covers manufacturing defects, hardware failures under normal use, and firmware issues.
• It does not cover: physical damage caused by misuse, exposure to liquids, voltage spikes, unauthorised disassembly, or use outside the rated electrical specification.
• To claim warranty, email info@air-obd.com with the order number and a description of the issue. We may ask for the device to be returned for inspection.
• If the defect is confirmed, we repair or replace the device at no charge. Where neither is reasonably possible, we refund the purchase price.

8. Use of the device on vehicles — your sole responsibility

AIR OBD is a passive, peer-to-peer conduit. It transparently forwards data between your diagnostic tool and the vehicle’s OBD2 port over a direct link between your Master and Slave devices. EUSPRO does not see, inspect, filter, alter, or control the data that passes through the bridge, and does not know what tool you use, what vehicle you connect to, or what operations you perform. Every diagnostic, coding, programming, or reset action is performed by your tool and initiated by you — not by AIR OBD and not by EUSPRO.

You are solely and fully responsible for ensuring that:

• You own the vehicle or hold explicit authorisation from its owner to work on it;
• You hold the technical competence and any licences required for the intended operation;
• The operation is lawful in the jurisdiction where the vehicle is located and where you are, including road-safety, emissions, type-approval, immobiliser, odometer, and data-protection laws;
• You have a valid legal basis to process any personal data that may be present in the vehicle (e.g. navigation history, paired phones, driver profiles);
• Backups are taken and recovery procedures are in place before any write, coding, or programming operation.

To the maximum extent permitted by law, EUSPRO is not liable for any loss, damage, claim, fine, or penalty arising from or connected with your use of the Products, including without limitation: damage to the vehicle, ECU, or any connected component; bricked or corrupted modules; loss of vehicle data; failed inspections or loss of type approval; regulatory fines; and any claim brought against you by a vehicle owner, insurer, manufacturer, or public authority. You will indemnify EUSPRO as set out in Section 13.

The prohibited uses listed in Section 3 apply in full to every use of the Products.

9. Intellectual property

All content on the Site (text, images, logos, graphics, code, firmware) is the property of UAB EUSPRO or its licensors and is protected by intellectual property law. The names «AIR OBD», «EUSPRO», «FAYTON», and «SOLARSAN» are registered trademarks. You may not copy, modify, distribute, sell, or lease any part of our content or software without our prior written permission.

10. Third-party services and links

The Site uses or links to third-party services (Stripe for payments, Google Analytics, Telegram and WhatsApp for support). Each third party is governed by its own terms and privacy policy. We are not responsible for content, practices, or availability of third-party sites.

11. Disclaimer

The Site, dashboard, and Products are provided «as is» and «as available». To the maximum extent permitted by law and without prejudice to your statutory consumer rights, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site or the bridge service will be uninterrupted, error-free, or free of malicious code.

12. Limitation of liability

To the maximum extent permitted by applicable law:

• EUSPRO is not liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, business interruption, or vehicle downtime.
• Our total cumulative liability arising out of or in connection with these Terms or your use of the Products is capped at the price you paid for the Product giving rise to the claim.
• Nothing in these Terms excludes or limits our liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Lithuanian or EU consumer law.

13. Indemnification

You agree to indemnify and hold harmless UAB EUSPRO, its officers, employees, and agents from any third-party claim arising from (a) your use of the Site or Products, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

14. Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, sanctions, postal carrier failures, or major internet outages.

15. Changes to these Terms

We may update these Terms when our practices or products change. The «Effective» date at the top reflects the current version. Continued use of the Site or Products after changes are posted constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Lithuania and applicable EU consumer law, without regard to conflict-of-law principles. Disputes shall be resolved exclusively in the competent courts of Vilnius, Lithuania, except where mandatory consumer protection laws of your country of residence grant you the right to bring proceedings there.

EU consumers may also use the European Commission’s Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
